Terms for the sale of used equipment to business customers
These terms concern equipment sold by IB-Lenhardt AG. Individually agreed terms take precedence.
1. Seller and customers
The seller is IB-Lenhardt AG, Heinrich-Hertz-Allee 7, 66386 St. Ingbert, Germany. Sales are exclusively to business customers acting in their trade or independent professional capacity within the meaning of Section 14 of the German Civil Code. We do not sell to consumers.
2. Used equipment and scope of supply
Equipment is sold used and in its described condition. The description of the individual instrument and express agreements determine its condition, configuration and scope of supply. No voluntary guarantee is provided.
Inspection and thorough functional testing at our laboratory are available by prior appointment. Please take account of disclosed wear, missing accessories and limitations before purchasing.
3. Price, payment and additional services
The prices and taxes shown for the specific offer apply. Payment is exclusively in advance. Payment details are provided during order processing.
Transport, special packaging and additional calibration are quoted individually and agreed separately. They are included only if expressly agreed. Please clarify the scope and cost before ordering.
4. Handover, collection and delivery
Handover takes place by arrangement after receipt of payment. Personal collection at IB-Lenhardt AG is available by appointment. Depending on the instrument, transport may be by a customer-commissioned freight forwarder or by insured UPS or DHL Express shipment. International delivery is arranged individually.
5. Optional calibration
Calibration by the manufacturer or by a DAkkS-accredited calibration laboratory can be arranged on request. Feasibility, scope, cost and timing must be agreed for the specific instrument. Calibration is not included in the purchase price unless expressly agreed.
6. Liability for defects
Claims for defects in used equipment are excluded. This exclusion does not apply to fraudulently concealed defects, an expressly assumed guarantee of quality, or the absence of an expressly agreed characteristic.
Claims for damages arising from intent or gross negligence, injury to life, body or health, and under the German Product Liability Act remain unaffected. In the event of a slightly negligent breach of an essential contractual obligation, liability remains but is limited to foreseeable damage typical of the contract. Essential contractual obligations are those that enable proper performance of the contract and on whose fulfilment the other party may ordinarily rely.
7. Withdrawal and contact
As sales are exclusively to business customers, statutory consumer withdrawal rights do not apply. Rights that cannot validly be excluded remain unaffected.
